  1. ACCEPTANCE OF TERMS

By accessing and using djohanarts.com (“Site”), you accept these
Terms & Conditions fully.

If you don’t agree, stop using the Site immediately.

We may modify these Terms anytime. Changes are effective immediately
when posted. Your continued use means you accept the changes.

  1. SITE USE & LICENSE

We grant you a limited license to use this Site for personal,
non-commercial purposes only.

You agree NOT to:
✗ Copy, reproduce, or distribute Site content without permission
✗ Use bots, scrapers, or automated tools
✗ Access parts of the Site you’re not authorized to access
✗ Interfere with the Site’s operation
✗ Use the Site for illegal purposes
✗ Impersonate others
✗ Harass, threaten, or abuse anyone
✗ Infringe copyright or intellectual property

Violation = immediate account termination and possible legal action.

  • May contain errors or inaccuracies
  • Are subject to change without notice
  • Do not constitute a binding offer

We reserve the right to:

  • Correct pricing errors
  • Refuse any order
  • Limit quantities per customer
  • Discontinue any product
  • Cancel orders for any reason

Orders are NOT binding until we send a confirmation email.

  1. PRICING & PAYMENT

Prices:

  • In USD unless stated otherwise
  • May change without notice
  • Include product + printing cost
  • Do NOT include shipping or taxes

Payment:

  • Full payment required at checkout
  • Accepted: Credit card, PayPal, Stripe, [otros]
  • Processed by secure third-party providers
  • We do NOT store your credit card information
  • By submitting payment, you authorize the charge

We reserve the right to refuse payment or cancel orders suspected
of fraud.

  1. ORDERS & FULFILLMENT

How orders work:

  1. You place order → Confirmation email sent
  2. We verify & approve → Production begins
  3. Printful prints product → Ships to you
  4. You receive → Delivery complete

Processing time:

  • 3-5 business days (does NOT include shipping)
  • Additional 1-2 days for design verification if needed

Shipping:

  • Handled by Printful (our fulfillment partner)
  • See our Shipping Policy for estimates
  • We are NOT responsible for carrier delays or damage
  • Once carrier receives package, risk is yours
  • For lost/damaged items, file claim with carrier
    (We will help you file the claim)

Your responsibility:

  • Provide accurate shipping address
  • Check address before completing purchase
  • We are not responsible for delivery to wrong address
  1. THIRD-PARTY SERVICES

We use third parties:

  • Printful → Printing & fulfillment
    https://www.printful.com/policies/terms
  • PayPal / Stripe → Payment processing
  • Google Analytics → Site analytics
  • [Hosting provider] → Hostinger

We are NOT responsible for:
✗ Third-party service failures
✗ Data breaches by third parties
✗ Third-party content or policies
✗ Third-party website operation

You agree to third-party terms & conditions when using their services.

  1. INTELLECTUAL PROPERTY RIGHTS

Our content:

  • All Site designs, text, images, logos are our property
  • Protected by copyright & trademark laws
  • Cannot be used, copied, or modified without permission

Your responsibility:

  • You own content you upload (photos, comments)
  • You grant us rights to use your content on our Site
  • You warrant you own/have rights to that content
  • You’re liable if your content infringes third-party rights

Design license:

  • You may use purchased designs for personal use
  • You may NOT resell, redistribute, or modify designs
  • You may NOT claim designs as your own
  1. LIMITED WARRANTY

What we warrant:
✓ Products are manufactured to Printful standards
✓ Designs will print as shown
✓ Delivery will be attempted as scheduled

What we DON’T warrant:
✗ Merchantability (product quality)
✗ Fitness for particular purpose
✗ Durability after use
✗ Color accuracy on screen vs. actual product
✗ Site operation (error-free, uninterrupted)

This warranty is your ONLY remedy for defects.

  1. DISCLAIMER OF WARRANTIES

EXCEPT AS STATED IN SECTION 8:

Products and Site are provided “AS IS” and “AS AVAILABLE.”

We make NO other warranties, express or implied, including:
✗ Merchantability
✗ Fitness for a particular purpose
✗ Non-infringement
✗ Quality
✗ Accuracy
✗ Completeness
✗ Non-interruption

Use at your own risk.

  1. LIMITATION OF LIABILITY

IMPORTANT – READ CAREFULLY:

In NO event shall D’Johan Arts be liable for:

✗ Direct damages (defective products)
✗ Indirect damages (lost profit, lost data)
✗ Incidental damages (inconvenience, time lost)
✗ Consequential damages
✗ Punitive damages

MAXIMUM LIABILITY:
Our total liability in any case = amount you paid for the product

Even if we’ve been advised of possible damages.

Some places don’t allow liability limits. In those cases,
our liability is limited to what local law allows.

✗ Spam or send unsolicited messages
✗ Reverse engineer or modify the Site
✗ Sell your account or access to others

Violation consequences:

  • Immediate account termination
  • Loss of any refunds owed
  • Legal action
  • Police involvement (for serious violations)
  • Permanent ban from Site
  1. INDEMNIFICATION

You agree to defend and indemnify D’Johan Arts against:

  • Any claims, damages, costs, losses arising from:
  • Your use of the Site
  • Your violation of these Terms
  • Your violation of any law
  • Your infringement of rights
  • Your content

This includes:

✗ Court costs
✗ Settlement amounts
✗ Other legal expenses

We’ll notify you of claims and let you defend them.

  1. DISPUTE RESOLUTION & GOVERNING LAW

Informal resolution (TRY FIRST):

  2. Include order number & issue details
  3. We respond within 5 business days
  4. We’ll try to resolve amicably

If informal fails:

Binding Arbitration:

  • Disputes resolved by neutral arbitrator (not court)
  • Faster & less expensive than lawsuit
  • Both sides present evidence
  • Arbitrator’s decision is final
  • Limited appeal rights

OR Small Claims Court:

  • If claim is under $5,000, either party can sue in small claims
  • No arbitration required for small claims

Governing Law:

  • These Terms are governed by laws of Jamaica
  • Any legal action is in Jamaica courts
  • (Unless arbitration clause applies)
  1. TIME LIMIT FOR CLAIMS

Any claim MUST be filed within 1 YEAR of the dispute.

After 1 year:
✗ You forfeit all rights
✗ We have no obligation
✗ You cannot take legal action

This prevents old claims from surfacing years later.

  1. MODIFICATIONS & TERMINATION

We may:

  • Modify these Terms anytime
  • Terminate your account for violations
  • Discontinue the Site (with 30 days notice)

You may:

  • Stop using the Site anytime
  • Request account deletion
  • Unsubscribe from emails

Upon termination:

  • You lose Site access
  • Outstanding orders still fulfilled
  • Refunds per Return Policy

Previous agreements are superseded.

No changes valid unless in writing signed by both parties.

  1. SEVERABILITY

If any provision is found invalid:

  • That provision is severed
  • Rest of Terms remain in effect
  • Invalid provision replaced with valid one achieving same intent
